By accessing or using Every Mood Studio ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Every Mood Studio is an AI-powered platform for generating ambient music videos, including audio, visuals, and related content. The Service uses artificial intelligence and third-party providers to create content based on user inputs.

3. No Guarantees

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND. We make no guarantees regarding:

The quality, accuracy, or suitability of generated content
Uninterrupted or error-free operation of the Service
The success or monetization potential of content created using the Service
Compatibility with any third-party platforms, including YouTube
The availability of any specific features or capabilities

4. User Responsibilities

You are solely responsible for:

All content you create using the Service
Ensuring your content complies with applicable laws and platform policies
Any consequences arising from uploading or distributing generated content
Maintaining the security of your account credentials

5. Intellectual Property

Content generated through the Service is provided for your use. However, we make no representations about exclusive ownership or the uniqueness of generated content. Similar or identical content may be generated for other users. You are responsible for ensuring your use of generated content does not infringe on any third-party rights.

Music generated using AI may not be eligible for copyright protection under applicable law. Users are responsible for verifying the commercial rights of any content before monetizing it.

6. Credits and Payments

Credits are consumed when generating content, regardless of whether you use the output
Subscription credits expire at the end of each billing period unless otherwise stated
Extra credit packs do not expire
No refunds are provided for unused credits or dissatisfaction with generated content
Prices may change at any time with notice to active subscribers

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EVERY MOOD STUDIO AND ITS OPERATORS SHALL NOT BE LIABLE FOR:

Any indirect, incidental, special, consequential, or punitive damages
Loss of profits, revenue, data, or business opportunities
Any damages exceeding the amount you paid to us in the 12 months prior to the claim
Any issues arising from third-party services, AI providers, or platform policies

8. Third-Party Services

The Service relies on third-party AI providers and services. We are not responsible for any issues, changes, or limitations imposed by these third parties. The availability and quality of AI-generated content may vary.

9. Prohibited Uses

You may not use the Service to:

Generate illegal, harmful, or offensive content
Infringe on intellectual property rights
Circumvent usage limits or access controls
Resell or redistribute the Service itself
Engage in any activity that disrupts or damages the Service

10. Multi-Account Policy

Each individual is permitted to maintain no more than one (1) active account on the Service. Creating multiple accounts to obtain additional free credits, circumvent usage limits, or abuse promotional offers is strictly prohibited.

We employ technical measures — including but not limited to IP address tracking, browser fingerprinting, and email analysis — to detect and prevent multi-accounting. If we reasonably suspect that multiple accounts are operated by the same individual:

We reserve the right to suspend or permanently terminate all associated accounts without prior notice
Any credits (including purchased credits) on flagged accounts may be forfeited
Refunds will not be issued for accounts terminated due to multi-accounting violations
Previously issued refunds for accounts later identified as part of a multi-account scheme may be reversed where permitted by law

11. Account Termination

We reserve the right to suspend or terminate your account at any time, for any reason, without notice or liability. You may also terminate your account at any time. Upon termination, you lose access to all credits and generated content.

12. Modifications

We may modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the new Terms. Material changes will be communicated via email or in-app notification.

13. Governing Law

These Terms are governed by the laws of Portugal and the European Union.

14. Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration, except where prohibited by law. Class actions and class arbitrations are waived.

15. AI-Generated Content Disclaimer

EveryMoodStudio provides tools to generate audio and visual content using third-party AI models for music, image and video generation. Users are solely responsible for compliance with the terms of service and content policies of any platform on which they publish generated content, including but not limited to YouTube, Spotify, TikTok, and Instagram.

16. No Guarantee of Monetization

EveryMoodStudio makes no representation that content generated through the platform will be eligible for monetization on any third-party platform. YouTube's AI content policy (effective July 15, 2025) and similar policies on other platforms may restrict monetization of AI-generated content. Users are responsible for adding sufficient transformative human input as required by destination platforms.

17. No Guarantee Against Content ID Claims

AI-generated audio may be subject to Content ID claims on YouTube and similar systems on other platforms. EveryMoodStudio does not guarantee that generated content will be free from third-party claims and provides no legal protection against such claims.

18. Third-Party Licensing

Music generation uses third-party AI music models. Users acknowledge they have read and accept the licensing terms of these underlying providers. Commercial use rights are subject to the terms of these third-party providers and may be modified or revoked at the provider's discretion.

19. Refund Policy for Platform Rejections

Credits used to generate content that is later rejected, claimed, or demonetized by third-party platforms are non-refundable, as these outcomes are determined by external systems outside EveryMoodStudio's control.
